Who we are
Foley Family Mediation & Child Consultancy ("we", "us") is a family dispute resolution and child consultancy practice run by Rebecca Foley, Registered Family Dispute Resolution Practitioner, from 1/169 Kelvin Grove Rd, Kelvin Grove QLD, and online.
This policy explains how we collect, use, store and share your personal information when you visit our websites, contact us, or use our services. We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth).
What we collect and how
We only collect the information we need to respond to you and provide our services.
| What | Examples | How we get it |
|---|---|---|
| Contact details | Name, phone number, email address | Enquiry forms, phone calls, emails, online bookings |
| Details of your enquiry | The service you're interested in and a brief outline of your situation | Enquiry forms, phone calls, emails |
| Information for your matter | Details about you, the other party and your children, and the issues in dispute | Intake sessions, mediation sessions and documents you give us |
| Payment details | Invoices and payment records (card details are handled by the payment provider, e.g. PayPal, not stored by us) | When you pay for a service |
| Website and ad data | Pages visited, the ad you clicked, device and browser type, approximate location | Cookies and similar tools (see below) |
Some information about family matters is sensitive, for example information about health, family violence or children's wellbeing. We only collect it when it's needed for our services and with your consent, or where the law allows.
You can make a general enquiry without giving your full name. To provide mediation services, we will need to know who you are.
How we use and share it
We use your information to:
- respond to your enquiry and arrange your free consultation
- assess whether mediation is suitable and safe, and provide our services
- issue certificates and documents required for family dispute resolution, such as a Section 60I certificate
- send invoices and take payments
- keep the records we're required to keep
- improve our website and advertising
We do not sell or rent your personal information, and we don't use it for anyone else's marketing.
We share information only where needed to provide our services or where the law requires it:
| Who | Why | Where they store data |
|---|---|---|
| Google (Ads, Analytics, Maps) | Advertising, measuring which ads lead to enquiries, showing our location | United States and other countries |
| Our website and form providers | Hosting our pages and sending enquiry forms to our inbox | United States |
| Microsoft 365 (our email and file storage) | Receiving and storing emails and documents | Australia and other countries |
| PayPal and our booking system | Online bookings and payments | United States and other countries |
| Courts, government agencies or other parties | Only where required or authorised by law, e.g. to protect a child or someone at risk | Australia |
Because some of these providers store data overseas, your information may be held in the United States and other countries. We choose established providers and take reasonable steps to make sure they protect it.
We don't use automated systems to make decisions about you.
Our websites, cookies and advertising
Our websites use cookies and similar tools from Google to show our ads and measure whether they work. For example, when you click one of our Google ads, a code from that click is kept with any enquiry you send, so we can see which ads lead to enquiries. This doesn't tell us who you are unless you send us your details.
Google Analytics shows us how people use our website, such as which pages are visited and for how long. We use this in summary form to improve the site.
You can block or delete cookies in your browser settings, and manage the ads Google shows you in Google's My Ad Centre at myadcenter.google.com. The website will still work if you block cookies.
Confidentiality, storage and security
What you tell us during family dispute resolution is confidential. The Family Law Act 1975 (Cth) sets out limited exceptions, for example where there is a risk to a child or a serious threat to someone's safety. Rebecca explains these at your intake session.
We keep personal information in password-protected systems and limit access to people who need it to provide our services. Paper records are stored securely at our office.
We keep information only as long as we need it for our services or as required by law and professional standards, then securely destroy or de-identify it. Enquiry details that don't lead to a booking are deleted when no longer needed.
Access, correction and complaints
You can ask to see the personal information we hold about you, or ask us to correct it. Contact us using the details below. We'll respond within 30 days. If we can't give you access, for example because it would affect another person's privacy or safety, we'll explain why.
If you're concerned about how we've handled your information, please contact us first. We'll look into it and reply in writing within 30 days.
If you're not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC):
